1. Introduction

This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name scheduler.example.com ('Website'), including the related mobile site and mobile application (collectively referred to as the 'Platform').

The Platform is owned by Appointment Scheduler, a proprietorship firm registered under Sanstha Aadhaar (formerly known as "Rajasthan Business Register") with the Directorate of Economics & Statistics, Government of Rajasthan, with its registered office at 153a, Deiwalo Ka Mohalla, Patan, Neem Ka Thana, 332718, Rajasthan, India (hereinafter referred to as 'Appointment Scheduler', 'Platform Owner', 'we', 'us', 'our').

2. Acceptance of Terms

Your use of the Platform and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform, including the applicable policies which are incorporated herein by way of reference. By accessing, browsing, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, please do not use the Platform.

If you transact on the Platform, you shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, you shall be contracting with the Platform Owner, and these terms and conditions, including the policies, constitute your binding obligations with the Platform Owner.

Any terms and conditions proposed by you which are in addition to or which conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect.

3. Modifications to Terms

We reserve the right to modify these Terms of Use at any time without prior notice. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform following the posting of changes constitutes your acceptance of such changes. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

4. Eligibility

To use the Platform, you must be at least 18 years of age and possess the legal authority to enter into a binding agreement. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind such organization to these Terms of Use.

5. Account Registration and Security

5.1. To access and use certain Services, you must register and create an account on the Platform. You agree to provide true, accurate, current, and complete information during the registration process and to update such information to keep it true, accurate, current, and complete.

5.2. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

5.3. We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Platform if we suspect that you have violated these Terms of Use.

6. User Conduct

You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal, or forbidden by these Terms, or applicable laws. Prohibited activities include, but are not limited to:

  • 6.1. Engaging in any activity that interferes with or disrupts the Platform or servers or networks connected to the Platform.
  • 6.2. Attempting to gain unauthorized access to any portion of the Platform or any other accounts, computer systems, or networks connected to the Platform.
  • 6.3. Using any automated means, including bots, robots, spiders, or crawlers, to access the Platform or collect any information from the Platform.
  • 6.4. Uploading, posting, or otherwise transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
  • 6.5. Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

7. Intellectual Property Rights

7.1. The Platform and its contents, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the property of the Platform Owner or its content suppliers and are protected by Indian and international copyright, trademark, and other intellectual property laws.

7.2. You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws.

7.3. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform and Services for personal, non-commercial purposes.

8. Third-Party Links

The Platform may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

9. Payment Terms

9.1. Payment Methods and Currency:

  • We accept payments in Indian Rupees (INR) only
  • Accepted payment methods include:
    • Credit/Debit Cards (Visa, MasterCard, American Express)
    • Net Banking (All major Indian banks)
    • UPI (All major UPI apps)
  • All payments are processed through PCI DSS compliant payment gateways
  • Payment processing fees are included in the displayed price

9.2. Payment Processing:

  • Payments are processed immediately upon confirmation
  • You will receive a payment confirmation email within 24 hours
  • Failed payments will be automatically refunded within 5-7 business days
  • We reserve the right to refuse any payment at our discretion

9.3. Refunds:

  • Refunds are processed in accordance with our Refund Policy
  • Refunds will be credited to the original payment method
  • Refund processing time is 5-7 business days
  • You will receive a refund confirmation email once processed

9.4. Taxes:

  • All prices include applicable taxes
  • Tax invoices will be provided for all transactions
  • You are responsible for any additional taxes in your jurisdiction

10. Disclaimer of Warranties

10.1. THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.2. WE DO NOT WARRANT THAT THE PLATFORM OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS IN THE PLATFORM OR SERVICES WILL BE CORRECTED.

10.3. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE PLATFORM IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

11. Limitation of Liability

11.1. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM OR SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (III) ANY CONTENT OBTAINED FROM THE PLATFORM; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11.2. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM OR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE DATE OF THE CLAIM.

12. Indemnification

You shall indemnify and hold harmless Platform Owner, its affiliates, group companies (as applicable), and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms of Use, Privacy Policy, and other Policies, or your violation of any law, rules, or regulations or the rights (including infringement of intellectual property rights) of a third party.

13. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event, including but not limited to acts of God, natural disasters, acts of government, acts of terror, civil commotions, strikes, lockouts, and industrial disputes.

14. Governing Law and Jurisdiction

14.1. These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.

14.2. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Sikar, Rajasthan, India.

15. Severability

If any provision of these Terms of Use is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.

16. Entire Agreement

These Terms of Use constitute the entire agreement between you and us regarding the use of the Platform and Services, superseding any prior agreements between you and us relating to your use of the Platform or Services.

Email Communications

By using our Platform, you agree to receive essential transactional emails related to your account and appointments. These emails are necessary for the proper functioning of our services and include:

  • Appointment confirmations and reminders
  • Review requests after appointments
  • Account-related communications

We do not send marketing or promotional emails. All transactional emails include an unsubscribe option, and we process unsubscribe requests within 24 hours.
